Equitable Distribution

What is Equitable Distribution? This is the process of dividing assets and even debts accumulated while married and is part of divorce proceedings.

North Carolina law provides for equitable distribution of assets equally in general. If the court decides equal division would not be equitable, they will consider a variety of factors to determine how to make the division of property equitable and fair.

There are three steps involved in the equitable distribution process. First, the court determines which property is from your marriage and which property is separate. Secondly, the court then assigns a fair market value to the assets that are to be distributed between the parties. And finally, the distribution process.
