What is Probate? Whether you have a will or not, when you die this is the legal process of distributing your assets. It is court-supervised and gives the surviving spouse, close family member or friend the authority to gather the deceased person’s assets, pay any outstanding debts and taxes, and transfer the remaining assets to the heirs of the estate.

In North Carolina, this process is administered by the elected Clerk of Superior Court.
